Terms of Service

These Terms of Service ("Terms") govern your access to and use of MarketSquad (the "Service"), operated by MarketSquad ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

MarketSquad is an autonomous AI marketing platform. You describe your product, and a system of AI agents researches your market, produces a marketing plan, and — subject to the controls and approvals you set — creates and publishes marketing content and runs paid ad campaigns on advertising and social accounts you connect.

2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity that occurs under your account.

3. Subscriptions, billing & trials

  • Plan. The Service is offered on a paid subscription (currently $39/month). A free trial may be offered; a payment method is required to start it, and unless you cancel before the trial ends, your subscription begins automatically.
  • Billing. Subscriptions are billed in advance on a recurring basis through our payment processor, Stripe. You authorize us to charge your payment method for the subscription and any applicable taxes.
  • Cancellation. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.
  • Ad spend is separate. Any advertising spend is billed to you directly by the ad platforms (e.g., Meta, Google, Reddit) on your own connected accounts. We never hold your funds or charge you for ad spend.

4. Your content & connected accounts

You retain ownership of the content, materials, and product information you provide ("Your Content"). You grant us a limited license to process Your Content to operate and provide the Service. When you connect a third-party account (such as an ad, social, or email account), you authorize us to take the actions you enable — such as publishing posts, sending email, and creating or managing ad campaigns — on your behalf. You are responsible for:

  • Having the rights and permissions to the accounts and content you connect and provide;
  • Complying with the terms, policies, and advertising rules of every platform you connect;
  • The budget caps, approvals, and autonomy settings you configure; and
  • Reviewing outputs before they are published where you have chosen manual approval.

5. AI-generated output

The Service uses artificial intelligence to generate research, plans, copy, and creative. AI output may contain errors or inaccuracies and is provided to assist you, not to replace your judgment. You are responsible for reviewing output and for any content you publish. We do not guarantee any particular marketing result, reach, engagement, or return on ad spend.

6. Acceptable use

You agree not to use the Service to:

  • Break the law or infringe others' rights;
  • Send spam or engage in deceptive, fraudulent, or misleading marketing;
  • Create fake accounts, artificial engagement, or astroturfing;
  • Market to accounts or audiences you are not authorized to market to; or
  • Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.

7. Third-party services

The Service integrates with third parties (including advertising and social platforms, our AI provider, and our payment processor). Your use of those services is governed by their terms, and we are not responsible for their acts, omissions, availability, or charges.

8. Intellectual property

The Service, including its software, design, and branding, is owned by us and protected by law. These Terms do not grant you any rights in our intellectual property except the limited right to use the Service in accordance with these Terms.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could cause harm or legal exposure. Upon termination, your right to use the Service ends; provisions that by their nature should survive will survive.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
